Terms of Use
1. Acceptance of Terms
By accessing or using Scanheim, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you may not access or use the service. These Terms constitute a legally binding agreement between you and Scanheim regarding your use of our platform. You also agree that accounts may be terminated with or without cause at our discretion.
2. Description of Service
Scanheim provides a platform for creating, managing, tracking, and analyzing QR codes. Our service allows you to create custom QR codes, organize them into campaigns, and track analytics related to their usage. The service may change from time to time as we update and improve our offerings.
3. Account Registration and Security
To use certain features of the service, you must create an account with a valid email address, name, and secure password. You are responsible for:
- Maintaining the confidentiality of your account information.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
- Ensuring that your account information is accurate and up to date.
4. Subscription and Payments
Scanheim offers various subscription plans with different features and limitations. By subscribing to our service:
- You agree to pay all fees associated with your selected plan.
- You authorize us to charge your payment method for these fees.
- You acknowledge that subscriptions automatically renew unless canceled before the renewal date.
- You understand that certain actions may be limited based on your subscription tier.
We reserve the right to change our pricing and subscription offerings at any time, with notice to active subscribers.
5. Refund Policy
Our refund policy is designed to be customer-friendly while preventing abuse:
45-Day Money-Back Guarantee
We offer a 45-day, no-questions-asked money-back guarantee for all plans, provided the account has not had excessive use prior. If you're not satisfied within your first 45 days, you're entitled to a full refund. We reserve the right to determine that an account has had excessive use if legitimate activity exceeds at least 10% of the subscribed plan's limits before a request was made.
One-Time Guarantee
This guarantee is available once per customer and is tied to your email address and billing information. Customers who have previously received a refund are not eligible for additional refunds as it demonstrates a pattern of abuse. We reserve the right to determine whether subsequent refunds are acceptable.
Subscription Cancellations
You may cancel your subscription at any time through your account settings or by contacting our support team. No partial refunds are offered, the subscription stops at the next billing cycle with the remaining time being fully paid. The money-back guarantee takes priority over this.
Service Interruptions
If our service is unavailable for more than 24 consecutive hours due to technical issues, we will provide a prorated refund or service credit upon request.
Annual Subscriptions
- Cancellations within 45 days: Full refund.
- Cancellations after 45 days: Partial refund at our discretion, minus a 10% processing fee.
Refund Eligibility
Users who have made substantial use of the service (defined as recording more than 10% of their plan's limits used) may be subject to review before a refund is approved.
Abuse Prevention
We reserve the right to deny refunds to users who demonstrate patterns of abuse, such as repeatedly subscribing and requesting refunds or violating our Terms of Use. Refunds are exclusive to one per person, and subsequent refunds by the same person may be denied.
Refund requests must be submitted through our support portal, including your account email address and purchase date. Refunds will be processed using the original payment method and may take up to 10 business days.
6. User Content and Conduct
You are solely responsible for all content you create using our service. We reserve the right to remove content and terminate accounts that violate these provisions. You agree not to:
- Create anything that links to illegal, harmful, or offensive content, including but not limited to hosting 18+ material.
- Violate any applicable laws, regulations, or third-party rights.
- Distribute malware, viruses, or other malicious code.
- Impersonate others or provide false information.
- Interfere with or disrupt the service.
- Use the service for spam, phishing, or deceptive practices.
7. QR Code Usage and Analytics
Our service provides analytics about how your QR codes are used. You understand and agree that:
- Analytics data is for informational purposes and may not be 100% accurate.
- Some scanning applications or devices may not register properly in our analytics.
- You will use the collected data in compliance with applicable privacy laws.
- Data collection is subject to limitations based on your subscription tier.
8. Intellectual Property
The Scanheim service, including its software, features, graphics, and content (excluding user-generated content), is privately owned and protected by intellectual property laws.
You retain ownership of the content you create but grant us a license to store, display, and process it as necessary to provide our services.
9. Limitation of Liability
To the maximum extent permitted by Philippine law:
- Scanheim provides the service "as is" without warranties of any kind.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim shall not exceed the amount you paid for the service during the 12 months prior to the claim.
- We are not responsible for the content linked to by QR codes you create.
- The application and the company behind it cannot be held liable for any loss of profit, material, property, possessions, etc., resulting from the use of the application, whether directly or indirectly.
10. Indemnification
You agree to indemnify and hold Scanheim and its affiliates harmless from any claims, damages, liabilities, costs, or expenses arising from your use of the service or violation of these Terms.
11. Modifications to the Service and Terms
We reserve the right to modify or discontinue the service or these Terms at any time. Material changes will be communicated via the service or email. Continued use after changes constitutes acceptance of the revised Terms.
12. Termination
We may terminate or suspend your access to the service immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. We reserve the right to blacklist anybody from our service at any time.
13. Governing Law
These Terms shall be governed by the laws of the Republic of the Philippines. By using our service, you agree to submit to the exclusive jurisdiction of the courts located in the Philippines.
14. Dispute Resolution
Any dispute shall first be addressed through good faith negotiations. If unresolved within 45 days, it shall be resolved through legal proceedings in the Philippines.
15. Consumer Protection
Nothing in these Terms limits your rights under Philippine consumer protection laws, including the Consumer Act of the Philippines (Republic Act No. 7394).
16. Copyright and Intellectual Property Claims
We respect intellectual property rights. If you believe content accessible via our service infringes your rights, please contact us with:
- A signature of the copyright owner or authorized agent.
- Identification of the copyrighted work.
- Identification of the infringing material.
- Contact information.
- A statement of good faith belief that use is unauthorized.
- A statement confirming accuracy under penalty of perjury.
Upon receiving a valid notice, we will remove or disable access to the infringing content and notify the responsible user.
17. Content Abuse and Reporting
Scanheim is committed to a safe environment. To report violations, submit:
- An identifier such as the QR Code Image or Link.
- A description of the problematic content.
- The reason you believe it violates our terms.
We will review and take appropriate action, including removal, warnings, or account termination for severe violations. While we strive for prompt review, response times may vary based on report volume and complexity.
